Trust Liechtenstein

The trust in Liechtenstein is comparable to the “trust settlement” or “family trust” of the Anglo-Saxon law. The experienced trust company, Artha Trust in Vaduz, supports clients worldwide with the establishment of a trust in Liechtenstein. A settlor, who transfers moveable or immovable assets to the trustee with the obligation to hold and manage the trust assets for the benefit of one or more beneficiaries, characterizes the founding process. The Liechtenstein trust is not a juridical person.

Formation of a trust in Liechtenstein

Artha Trust consults clients internationally, to establish a trust in Liechtenstein, and develops holistic solutions according to the expectations of every client. The trust can be established with a written agreement between the settlor and the trustee, or through a trust declaration and its acceptance. The agreement defines the terms and conditions of the relationship between the trustee and the settlor. The Liechtenstein trust can be registered into the Public Registry of the Principality of Liechtenstein.

The trustee is responsible for the administration of the trust. Moreover, he is personally responsible for the administration of the assets to the benefit of the beneficiaries. The profession as a trustee follows special regulations, in accordance to the trust law in Liechtenstein, which defines the admission of trustees. The work as trustee is related to an official authorisation of the FMA, the Financial Market Authority in Liechtenstein. The FMA oversees an international strong intertwined financial centre. The cooperation is intensely affected by the globalization and international clients.

Trust in Liechtenstein

The structure of a trust in Liechtenstein is similar to the structure of a foundation. The latter is one of the most common legal forms for wealth and asset management in Liechtenstein. A trust is according to local law a private wealth structure. The settlor can either designate himself or any other natural or legal person as beneficiary of the trust.

Artha Trust would be pleased to answer all questions with regard to the legal and effective structure of a trust, the declaration, the liquidation, the auditors, and the administrative body of the trust, as well as other relevant questions which may arise.
